Lawsuit of the Day: ELIZABETH RUSSETT of New York is suing the folks at Kellogg's for at least $5 million bucks, claiming that the fruit filling in the company's Frosted Strawberry Pop Tarts is mostly other fruits. TMZ reports the lawsuit claims the fruits inside are actually heavier on pears and apples than strawberries. And the suit claims the other fruits are not enough to provide the stated nutritional benefits, let alone a strawberry taste.
COVID: The CDC now says you should be careful and take precautions this Halloween. CDC Director ROCHELLE WALENSKY said yesterday "I would say put on those costumes, stay outside and enjoy your trick-or-treating." But she said “I wouldn't gather in large settings outside and do screaming like you are seeing in those football games." She also urged that people should get vaccinated, so you and your children will be safer.
And while we're on the subject, DR. FAUCI said over the weekend that he believes COVID vaccines for kids aged 5-11 will be available in early November.
COVID alert: Singer ED SHEERAN said in a post on his Instagram page that he is self-isolating after testing positive for Covid-19, but will be doing interviews and performing from home in Suffolk, England.
Passing: JAMES MICHAEL TYLER. Best known as Gunther on "Friends," he appeared in almost 150 episodes of the sitcom. He was diagnosed with advanced prostate cancer in 2018 which later spread to his bones. He was 59 years old.
Also passing: JAY BLACK, of JAY AND THE AMERICANS of complications from pneumonia. He was 82. The band announced his passing on their Facebook page, saying "We shared both wonderful and very contentious times, and much like an ex-wife, we are so proud of the beautiful children we created. We'll always remember The Voice."
And... SNOOP DOGG's, mom, BEVERLY TATE. She'd been hospitalized earlier this year for undisclosed reasons, and the cause of her death hasn't been revealed.
